Zimflow Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Zimflow platform and services (collectively, "Zimflow"). By accessing or using Zimflow, you ("you" or "user") agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use Zimflow.

Acceptance of Terms

By creating an account, accessing, or using Zimflow, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Account Registration and Use

You must be at least 18 years old to register for a Zimflow account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate and complete information when registering for an account and to keep your account information updated. You may not share your account with others. We reserve the right to suspend or terminate your account if we believe you have violated these Terms or engaged in any harmful or illegal activity.

Use of Zimflow

Zimflow allows you to build and deploy WhatsApp chatbots for your business. You are solely responsible for the content, functionality, and operation of your chatbots, as well as your interactions with your customers (end-users) through these chatbots. You agree to use Zimflow in compliance with all applicable laws and regulations in Zimbabwe and any other relevant jurisdiction, including laws related to data privacy, consumer protection, and electronic communications. You are responsible for obtaining any necessary consents from your chatbot users regarding data collection and processing. You may not use Zimflow to create chatbots that engage in illegal, harmful, abusive, harassing, defamatory, or otherwise objectionable activities. You may not attempt to interfere with the proper functioning of Zimflow or circumvent any security measures.

Intellectual Property

Zimflow Platform: The Zimflow platform, including its design, software, and content (excluding your chatbots and their data), is owned by [Your Business Name/Zimflow Legal Entity Name] and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use Zimflow in accordance with these Terms. Your Chatbot Content and Data: You retain ownership of the content and data of your chatbots. By using Zimflow, you grant us a non-exclusive, worldwide license to host, process, and transmit your chatbot content and data for the purpose of providing the Zimflow services to you.

Third-Party Integrations

Zimflow integrates with third-party services like Flowise and Voiceflow. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the functionality or availability of these third-party services.

Payment and Subscription

We may offer different subscription plans for Zimflow. The fees and features of each plan will be clearly outlined on our pricing page. By subscribing to a paid plan, you agree to pay the applicable fees. Payments will be processed through our third-party payment processors. Subscription fees are generally non-refundable, except as expressly stated in our refund policy (if any). We reserve the right to change our subscription fees at any time, with reasonable notice to you.

Termination

You may terminate your account at any time. We may suspend or terminate your access to Zimflow at any time, with or without cause, including if you violate these Terms. Upon termination, your right to access and use Zimflow will cease immediately.

Data Deletion Upon Termination

Upon termination of your account, we will initiate the process of deleting your account data, including your chatbot configurations and related data, from our active systems within a reasonable timeframe. Please note that some residual information may be retained in our backup systems for a limited period for security and disaster recovery purposes. You are responsible for separately backing up any chatbot data collected from your end-users if you wish to retain it.

Disclaimer of Warranties

Zimflow is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Zimflow will be uninterrupted, error-free, or secure.

Limitation of Liability

To the maximum extent permitted by applicable law, [Your Business Name/Zimflow Legal Entity Name] shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use Zimflow, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or your use of Zimflow shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the event giving rise to the liability.

Indemnification

You agree to indemnify and hold harmless [Your Business Name/Zimflow Legal Entity Name], its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of Zimflow, your chatbots, your violation of these Terms, or your violation of any rights of a third party.

These Terms shall be governed by and construed in accordance with the laws of Zimbabwe. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.

Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website or through other communication channels. Your continued use of Zimflow after the effective date of the revised Terms constitutes your acceptance of the changes.

Entire Agreement

These Terms constitute the entire agreement between you and [Your Business Name/Zimflow Legal Entity Name] regarding your use of Zimflow and supersede all prior or contemporaneous communications and proposals, whether oral or written.
